We are committed to protecting your personal information and your right to privacy. When you visit our website https://mcchorus.org (the “Website”), and more generally, use any of our services (the “Services”, which include the Website), we appreciate that you are trusting us with your personal information. We take your privacy very seriously. In this privacy policy, we explain what information we collect, how we use and disclose it, and what rights you have in relation to it. We hope you take some time to read through it carefully, as it is important. If there are any terms in this privacy policy that you do not agree with, please discontinue use of our Services immediately.


This privacy policy applies to all information collected through our Services, as well as, any related services, sales, marketing or events, including other information provided to us online or offline by third parties, when we associate that information with customers or users of the Services; however, it does not apply to information collected from our employees, singers, conductors, apprentices, artists-in-residence, volunteers, contractors, or vendors. It also does not apply to information that you ask us to share with third parties or is collected by Online Tool Providers (as defined in Section 3 below). You acknowledge and agree that we are not responsible for the data collection or use practices of any other Services user or third party utilized in providing the Services other than our service providers.


By accessing or using the Services, you consent to this privacy policy. If you do not agree with this privacy policy, please do not access or use the Services. Information gathered through the Services may be transferred, used, and stored in the United States or in other countries where our Service Providers (as defined in Section 3 below) or we are located. 1. WHAT INFORMATION DO WE COLLECT?


Personal information you disclose to us.


In Short: We collect personal information that you provide to us.


We collect personal information when you use the Website and when you voluntarily provide personal information to us by registering on the Website, express an interest in obtaining information about us or our products and Services, when you participate in activities on the Website or otherwise when you contact us.


The personal information that we collect depends on the context of your interactions with us and the Website, the choices you make and the products and features you use. The personal information we collect may include the following:


Personal Information Provided by You. We collect first and last names; phone numbers; email addresses; mailing addresses; billing addresses; debit/credit card numbers; and other similar information.


Payment Data. We may collect data necessary to process your payment if you make purchases, such as your payment instrument number (such as a credit card number), and the security code associated with your payment instrument. You may choose not to provide personal information (subject to the controls offered by your mobile device’s operating system), but this may prevent you from receiving certain features of the Services.


All personal information that you provide to us must be true, complete and accurate, and you must notify us of any changes to such personal information.


We also collect non-personal information relating to the Services, that is, information that does not personally identify an individual. The non-personal information we collect includes how you interact with the Services, information generally collected or “logged” by Internet websites or Internet services when accessed or used by users, and information about your web browser or device accessing or using the Services. 


Examples of the non-personal information we collect are:


  • The pages of our Website that you viewed during a visit;
  • What information, content or advertisements you view or interact with using the Services; 
  • The city and state in which you are located (but not your precise geographic location); and 
  • Unique identifiers that are not connected and cannot reasonably be connected to your identity. 


We will not use non-personal information to try to identify you, and if we associate any non-personal information with information that personally identifies you, then we will treat it as personal information. As discussed in more detail below, we sometimes use cookies and other automatic information gathering technologies to gather non-personal information. 


Information collected by the Services may be collected by us or one of our Service Providers or Online Tool Providers.

In Short: We process your information to fulfill your requests or with your consent, to provide the Services, and for our legitimate business purposes, including compliance with legal obligations.


We use the information we collect or receive:


  • To send administrative information to you. We may use your personal information to send you product, service and new feature information and/or information about changes to our terms, conditions, and policies.
  • To protect our Services. We may use your information as part of our efforts to keep our Website safe and secure (for example, for fraud monitoring and prevention).
  • To enforce our terms, conditions or policies for business purposes, to comply with legal or regulatory requirements in connection with our Services.
  • To respond to legal requests or to prevent harm. If we receive a subpoena or other legal request, we may need to inspect the data we hold to determine how to respond.
  • To process transactions with you. We may use your information to fulfill and manage your orders, donations, payments, returns, or exchanges made through the Services.
  • Administer prize draws and competitions. We may use your information to administer prize draws or competitions when you elect to participate.

  • To respond to your inquiries or provide support to you. We may use your information to respond to your inquiries and solve any potential issues you might have with the use of our Services.

For example, when expressing an interest in obtaining information about us or our Services, subscribing to marketing or otherwise contacting us, we will collect personal information from you. You can opt-out of our marketing emails as further described in the “WHAT ARE YOUR PRIVACY RIGHTS” section below.
  • Deliver targeted advertising to you. We may use your information to develop and display personalized content and advertising (and work with third parties who do so) tailored to your interests and/or location and to measure its effectiveness.


3. WILL YOUR INFORMATION BE SHARED WITH ANYONE?


In Short: We only share information with your consent, to comply with laws, to provide you with the Services, to protect your rights, or to fulfill business obligations, or as otherwise described in this privacy policy.


We do not sell your personal information but we may disclose your personal information to third parties as described below.

 

We may disclose personal information to provide the Services, or when you authorize or instruct us to do so, for example when you use the Services to submit content or profile information. The Services are a social experience, so we may disclose your interactions with the Services to social media platforms, when we link to social media services like Instagram or YouTube. We may also disclose personal information and non-personal information to Service Providers. By “Service Providers” we mean companies, agents, contractors, service providers, or others engaged to perform functions on our behalf (such as processing of payments, provision of data storage, hosting of our website, marketing of our products and services, and conducting audits). For example, we use Neon Pay to process transactions, and Constant Contact and Arts People for communications. When we use a Service Provider, we require that the Service Provider use and disclose the personal information and non-personal information received from us only to provide their services to us or as required by applicable law.


We may also disclose personal information and non-personal information to Online Tool Providers. By “Online Tool Provider” we mean a licensor of software that we include in, or use with, the Services, including an API or SDK, that provides a specialized function or service to us and that requires the transmission of personal information and/or non-personal information to the Online Tool Provider. Online Tool Providers may have the right to use personal information and non-personal information about you for their own business purposes. Use and disclosure of personal information and non-personal information by an Online Tool Provider is described in its privacy policy. See Section 4 below for examples of Online Tool Providers we use.


We may partner with advertisers to provide you with special offers, or to advertise products or services to you. If you redeem or respond to an offer, we may provide your personal information to the advertising partner, including your name and email address. If you answer questions or fill out surveys from an advertiser, we may share information with that advertiser. The advertising partner’s privacy policy will govern their use of your information, which may include marketing of other products or services to you. You should read each advertiser’s privacy policy before providing information to that advertiser. 


We may also disclose your personal information to third parties when we believe, in good faith and in our sole discretion, that such disclosure is reasonably necessary to (a) enforce or apply the terms and conditions of the Services, including investigation of potential violations thereof, (b) comply with legal or regulatory requirements or an enforceable governmental request, (c) protect the rights, property or safety of us, our users or other third parties, (d) prevent a crime or protect national security, or (e) detect, prevent or otherwise address fraud, security or technical issues. 


We also reserve the right to transfer information (including your personal information) to a third party in the event of a sale, merger, or transfer of all or substantially all of the assets of our organization relating to the Services, or in the unlikely event of a bankruptcy, liquidation, or receivership of our business. We will use commercially reasonable efforts to notify you of such transfer, for example via email or by posting notice on our website.


The Services may link or integrate with third-party sites, services or apps. We are not responsible for the privacy or security policies or practices or the content of such third parties. Accordingly, we encourage you to review the privacy and security policies and terms of service of those third parties so that you understand how those websites collect, use, share and protect your information.


We may also disclose non-personal information, aggregated with information about users of our Services, to our business partners, merchants, advertisers, investors, and other third parties if we deem such disclosure, in our sole discretion, to have sound business reasons or justifications. 


4. DO WE USE COOKIES AND OTHER TRACKING TECHNOLOGIES?


In Short: We may use cookies and other tracking technologies to collect and store your information.


Every time you use the Services (e.g., access a webpage), we collect personal information and non-personal information (as discussed above) regarding that use. For example, to improve our Services, we collect how, when, and which parts of the Services or its features you use, which social media platforms you connect to the Services, and when, how, and what you post to the social media platforms through the Service app. Also, we may use your device’s unique identifier (UDID) or other unique identifiers to assist us in collecting and analyzing this data.


To assist us in collecting and storing this non-personal information, we may employ a variety of technologies, including “Cookies,” local browser storage, and “web beacons,” “pixels,” or “tags.” A “Cookie” is a small amount of data a website operator, or a third party whose content is embedded in that website, may store in your web browser and that the website operator or, as applicable, the third party, can access when you visit the website. A web beacon, pixel or tag is a small, usually-transparent image placed on a web page that allows the operator of that image, which may be the operator of the website you visit or a third party, to read or write a Cookie.


Your operating system and web browser may allow you to erase information stored in Cookies and local browser storage. But if you do so, you may be forced to login to the Services again and you may lose some preferences or settings. You may also be able to set your browser to refuse all website storage or to indicate when it is permitted, but some features of our Services may not function properly without it. We may use Cookies to keep you logged in, save your preferences for the Services, and to collect information about how you use our Services.

An Online Tool Provider may collect information automatically, in which case personal information and non-personal information it receives are subject to the Online Tool Provider’s privacy policy. 5. HOW LONG DO WE KEEP YOUR INFORMATION?


In Short: We keep your information for as long as necessary to fulfill the purposes outlined in this privacy policy unless otherwise required by law.


We will only keep your personal information for as long as it is necessary for the uses set out in this privacy policy, unless a longer retention period is required by applicable law or to comply with other requirements (such as tax, accounting or other legal requirements).


When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize such information, or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will store your personal information using the security measures described in this privacy policy and isolate it from any further processing until deletion is possible.


6. HOW DO WE KEEP YOUR INFORMATION SAFE?


In Short: We aim to protect your personal information through a system of organizational and technical security measures.


We have implemented appropriate technical and organizational security measures designed to protect the security of any personal information we process. However, despite our safeguards and efforts to secure your information, no electronic transmission over the Internet or information storage technology can be guaranteed to be 100% secure, so we cannot promise or guarantee that hackers, cybercriminals, or other unauthorized third parties will not be able to collect, access, or modify your information. Although we will endeavor to protect your personal information, transmission of personal information to and from our Services is at your own risk. You should only access our Services within a secure environment.


7. DO WE COLLECT INFORMATION FROM MINORS?


In Short: We do not knowingly collect data from or market to children under 18 years of age.


We do not knowingly solicit data from or market to children under 18 years of age. By using the Services, you represent that you are at least 18. If we learn that personal information from users less than 18 years of age has been collected, we will deactivate the account and take reasonable measures to promptly delete such data from our records. 8. WHAT ARE YOUR PRIVACY RIGHTS?


In Short: You may review, change, or terminate your account at any time.

Account Information


If you would at any time like to review or change the information in your account or terminate your account, you can:


  • Contact us using the contact information provided.
  • Log in to your account settings and update your user account.


Upon your request to terminate your account, we will deactivate or delete your account and information from our active databases. However, we may retain some information in our files to prevent fraud, troubleshoot problems, assist with any investigations, to comply with applicable legal requirements, or for other legitimate business purposes.


We ask individual users to identify themselves and the information requested to be accessed, corrected, or removed before processing such requests, and we may decline to process requests that are unreasonably repetitive or systematic, require disproportionate technical effort, jeopardize the privacy of others, would be extremely impractical (for instance, requests concerning information residing on backups), or relate to information that is not associated with your personal information. In any case, where we provide information access and correction, we perform this service free of charge, except if doing so would require a disproportionate effort. 


Please be aware that if you ask us to delete your personal information in our possession, you may not be able to continue to use the Services. Also, even if you request that we delete your personal information, we may need to retain certain information for a limited period of time to satisfy our legal, audit and/or dispute resolution requirements.


Cookies and similar technologies: Most Web browsers are set to accept cookies by default. If you prefer, you can usually choose to set your browser to remove cookies and to reject cookies. If you choose to remove cookies or reject cookies, this could affect certain features or services of our Website. Opting out of email marketing: You can unsubscribe from our marketing email list at any time by clicking on the unsubscribe link in the emails that we send or by contacting us using the details provided below. Please note that it may take up to ten (10) business days for your opt-out request to be processed. You will then be removed from the marketing email list — however, we may still communicate with you, for example to send you service-related emails that are necessary for the administration and use of your account, to respond to service requests, or for other non-marketing purposes.

9. CONTROLS FOR DO-NOT-TRACK FEATURES


Most web browsers and some mobile operating systems and mobile applications include a Do-Not-Track (“DNT”) feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. At this stage no uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online. If a standard for online tracking is adopted that we must follow in the future, we will inform you about that practice in a revised version of this privacy policy. 


10. DO CALIFORNIA OR NEVADA RESIDENTS HAVE SPECIFIC PRIVACY RIGHTS?


In Short: Yes, if you are a resident of California, you are granted specific rights regarding access to your personal information. Nevada residents may contact us for additional information. 


You may have heard of the California Consumer Privacy Act which provides certain rights to California (CCPA) residents in connection with their personal information. Our Services are not currently subject to the CCPA. However, we do provide notice and transparency about our collection and use of personal information as described throughout the privacy policy.


California Civil Code Section 1798.83, also known as the “Shine The Light” law, permits our users who are California residents to request and obtain from us, once a year and free of charge, information about categories of personal information (if any) we disclosed to third parties for direct marketing purposes and the names and addresses of all third parties with which we shared personal information in the immediately preceding calendar year. If you are a California resident and would like to make such a request, please submit your request in writing to us using the contact information provided below.


However, under the law, an organization is not required to provide the above-described lists if the organization adopts and discloses to the public (in its privacy policy) a policy of not disclosing a customer’s personal information to third parties for their direct marketing purposes unless the customer first affirmatively agrees to the disclosure, as long as the organization maintains and discloses this policy. Rather, the organization may comply with the law by notifying the customer of his or her right to prevent disclosure of personal information to third parties for direct marketing purposes and providing a cost free means to exercise that right. 


We participate in a service that allows arts organizations to send communications to individuals with connections to other arts organizations. Personal information is never shared directly with the other organizations and is used by the service only for the limited purpose of providing this benefit. We are not paid for participating in this service. To request that your personal information be deleted from the service or that use of your personal information in connection with this service be limited, please email us at info@mcchorus.org. 

 

Please note that whenever you allow your personal information to be shared with a third party to communicate with you, your information will be subject to that third party’s privacy policy. If you later decide that you do not want that third party to use your information, you will need to contact the third party directly. You should always review the privacy policy of any party that collects your information to determine how that entity will handle your information.


If you are under 18 years of age, reside in California, and have a registered account with the Website, you have the right to request removal of unwanted data that you publicly post on the Website. To request removal of such data, please contact us using the contact information provided below, and include the email address associated with your account and a statement that you reside in California. We will make sure the data is not publicly displayed on the Website, but please be aware that the data may not be completely or comprehensively removed from all our systems (e.g. backups, etc.).


To the extent that there is a conflict between this California section and remainder of the privacy policy, this California section will prevail with respect to California residents only.

In Short: Yes, we will update this notice as necessary to stay compliant with relevant laws.


We may update this privacy policy from time to time. The updated version will be indicated by an updated “Revised” date and the updated version will be effective as soon as it is accessible. If we make material changes to this privacy policy, we may notify you either by prominently posting a notice of such changes or by directly sending you a notification. We encourage you to review this privacy policy frequently to be informed of how we are protecting your information.
